The Bob Project: Rules & Regulations

 

In order to submit photos and participate in The Bob Project, you must be a member of the Bob the Pleo forums and agree to these Official Rules (“Rules”). The Rules consist of the terms and conditions on this page and the submission requirements set forth in the Frequently Asked Questions (FAQ) page. Because you will be bound by these Rules and these Rules will form a legally binding agreement with respect to the Contest, please read them carefully. You agree that registration for the forums and/or a submission of an entry in The Bob Project constitutes your agreement to these Rules.

No purchase or payment of any kind is necessary to participate or submit photos to The Bob Project. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING, but you will earn our eternal gratification.

  1. Entering Contests, Choosing, and Contacting Winners
    1. The contests are open to members of the forums.

      The Bob Project is open to anyone currently a member of the Bob the Pleo forums or affiliated websites, except employees, agents, or representatives of Bob the Pleo (Michael Weed, the "Bob the Pleo" comic strip or BobThePleo.com), any sponsor, or any of its parents, subsidiaries, sister companies, or affiliates, or any member of their immediate family.

      If you are a minor, you must obtain the prior permission of your parent and/or legal guardian and your parent and/or legal guardian must also agree to these Rules on their and your own behalf before you can submit photos.

    2. All entries must be complete and submitted on time.

      To be eligible, entries must be completed and received on or by the closing date of The Bob Project. Entrants must submit entries using the correct entry form, forum post, and any other specific entry information requested in this website. Incomplete entries will be disqualified. Bob the Pleo and its owner is not responsible for and will not consider incomplete or incorrect entries, or entries lost, misdirected, delayed, garbled, or otherwise submitted but not received by Bob the Pleo for any reason, including hardware, software, browser, or network failure, malfunction, congestion, or incompatibility, as potential submissions. Entries received by telephone, fax, courier or personal delivery will not be accepted.

      Failure to comply with these Rules may result in disqualification from the Contest.

      Bob the Pleo, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Web site, or otherwise in violation of the rules. It further reserves the right to cancel, terminate, or modify in whole or part any portion of The Bob Project not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force of nature, or technical failures of any sort.

    3. Entries will be awarded points based on The Bob Project rules.

      Entries will be judged entirely at the discretion of Bob the Pleo or otherwise designated person(s) based on: artistic merit, creativity, theme communication, appropriateness of the supporting statement, and whether the submissions adhered to these Rules.

    4. Winners will be notified by Bob the Pleo.

      The recipients of any prizes must be 18 years of age or older, unless otherwise stated and/or posted. For any winner under the age of 18, the parent and/or legal guardian will be considered the winner for any and all legal purposes.

      Recipients of all prizes will be contacted at the member's email address used to register on the forums, and the person receiving and replying to the email will be considered the recipient unless they specify another person within the reply email as the entrant. Bob the Pleo will mail the prizes to the address supplied by the recipient of the email.

      Claiming of prizes requires an email or PM to Grumpy on the Bob the Pleo forums from the entrants email address or Bob the Pleo user ID.

  2. Submission of photo, text or other content
    1. All entries must be your own stuff.

      Entrants represent and warrant that their Submission is their original work, it has not been copied from others, and it does not violate the rights of any other person or entry. In other words, don't use other people's stuff.

      By submitting any photo or information to The Bob Project, you hereby represent and warrant that the submitted photo or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to Bob the Pleo herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances.

    2. Bob the Pleo needs to publish and use entries.

      All entries shall become the property of Bob the Pleo. The copyright in any submission shall remain the property of the entrant, but by submitting any photo or information to The Bob Project, you hereby grant to Bob the Pleo and its affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted photo or other information in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other things, the rights granted to Bob the Pleo includes but is not limited to the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and to otherwise alter or make use of the submitted photo;

      Photos or information submitted by you to the Site shall be the property of Bob the Pleo, and Bob the Pleo shall have no obligation to preserve, return or otherwise make available to you or others any photos or information so submitted.

    3. Other members will get to see your entries, and comment on them . . . unless we don't think they're appropriate.

      You understand and intend that any photo or information submitted by you to The Bob Project may be available for viewing, rating, review and comment on by the public, and understand that comments or ratings with which you disagree or are unhappy about may be published or otherwise become associated with any photo or information you submit to The Bob Project. By submitting any photo or information to The Bob Project, you hereby waive any privacy expectations that you may have with respect to any such photo or information submitted by you to The Bob Project

      You acknowledge and agree that Bob the Pleo shall have no obligation to post, display or otherwise make publicly available any photo or information submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any photo or information that you submit to The Bob Project,

    4. Don't blame us. You entered.

      You hereby agree to hold Bob the Pleo and its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any Bob the Pleo site, or any other use authorized under these Terms, of any photo or information submitted to The Bob Project by you.

  3. Awarding Prizes
    1. We just give out the prizes. You are responsible if the government cares you won.

      Recipients are solely responsible for all taxes and/or fees that may be incurred. Recipients outside of the United States of America are also solely responsible for all the import duties, taxes, and fees incurred by their government.

    2. We told you what the prize was up front. If you don't like it, don't enter.

      Recipients may not request substitutions of prize winnings. Bob the Pleo retains the rights, in its absolute and sole discretion, to make substitutions of equivalent kind or approximate value in the event of the unavailability of any prize or component of the prize for any reason whatsoever.

      The prizes are not redeemable in cash and must be accepted as awarded.

      In the event there are not enough eligible entries, not all prizes will be awarded.

    3. Again, don't blame us. We just give out the prizes.

      Neither Bob the Pleo, Bob the Pleo sponsors, nor employees of Bob the Pleo or sponsors may be held liable for any warranty, costs, damage, injury, or any other claims incurred as a result of usage of any winners of a prize once possession has been taken of the product by winner. Bob the Pleo is not liable for any loss arising out of or in connection with or resulting from any contest promoted by Bob the Pleo.

  4. General Conditions

    Bob the Pleo reserves the right to cancel, withdraw, terminate, postpone or modify the Contest at any time without prior notice.

    THe Bob Project is subject to all federal, state, and local laws and regulations, and are void where prohibited.

    Privacy Notice: By participating in The Bob Project, you agree that Bob the Pleo can collect your personal information, and that if we cannot collect the required data, you may not be eligible to participate in the Contest. Any personal information collected during the course of the Contest will only be used for administering the Contest and for other purposes as outlined in these Rules. You will have the right to access, review, rectify or cancel any personal data held by Bob the Pleo by contacting Bob the Pleo at the address listed above.

    No Recourse to Judicial or Other Procedures: To the maximum extent permitted by law, the rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with the Contest are hereby excluded, and you expressly waive any and all such rights.

    Severability: If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

    LIMITATIONS OF LIABILITY: To the maximum extent permitted by law, you INDEMNIFY AND AGREE TO KEEP INDEMNIFIED BOB THE PLEO AND MICHAEL WEED AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH OF ANY WARRANTY BY YOU SET FORTH HEREIN. To the maximum extent permitted by law, you INDEMNIFY AND AGREE TO KEEP INDEMNIFIED BOB THE PLEO AND MICHAEL WEED AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES FOR OR IN RESPECT OF WHICH BOB THE PLEO OR MICHAEL WEED WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE RULES INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE RULES BY YOU. To the maximum extent permitted by law, you AGREE TO HOLD BOB THE PLEO AND MICHAEL WEED HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE CONTEST AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON.
